A new case coming from Alberta (Schaufert v Calgary Co-operative Association Limited, 2021 ABQB 579) awarded a 24 month notice period (severance pay), in addition to bonuses that would have been granted and vested within the notice period. This award was given despite the employer’s severance policy purporting to restrict its employees’ common law rights for notice.
